Article 1Scope
These Terms set out the conditions for using the Echo AI Hub services (the “Service”) provided by [Business name] (“we” or “us”). Members shall use the Service after agreeing to these Terms.
Article 2Definitions
The main terms used in these Terms have the following meanings: “Member” means a person who has registered for the Service; “Token” means a usage allowance denominated in Japanese yen that is applied to the use of models; and “API key” means the credentials a member uses to call models.
Article 3Member registration
Registration requires agreement to these Terms and the Privacy Policy, and consent to your input being sent to model providers outside Japan. Member registration is limited to people aged [Age] or over.
Article 4Management of accounts and API keys
Members are responsible for managing their accounts and API keys, and must not allow any third party to use them.
Article 5Token purchases and expiry
Paid Tokens are valid for 180 days from the day the top-up is added to your balance, and free Tokens are valid for 90 days from the day they are granted. Tokens are used in order of expiry, starting with those that expire soonest, and any balance past its expiry date lapses.
Article 6Refunds
Purchased Tokens are not refundable, except where required by law. The same applies to Tokens that have lapsed.
Article 7Free Tokens
Free Tokens are granted only once per person. If we determine that they were received by improper means, we may revoke the grant.
Article 8Events and courses
Registration, waitlists and cancellation for events and courses are subject to the conditions stated on each event's page.
Article 9Prohibited conduct
The following are prohibited: acts that violate laws and regulations or public order and morals; acts that infringe the rights of others; unauthorized access; use for purposes prohibited by any model provider's terms of use or policies; and any other acts that we deem inappropriate.
Article 10External model providers
The Service uses services from external model providers. Outages, specification changes or the discontinuation of services on a model provider's side may make all or part of the Service unavailable. In such cases, our liability is as set out in [Scope of liability].
Article 11Rights to outputs
Ownership of the rights to outputs generated by models, and the conditions for using those outputs, are as set out in [Handling of outputs]. Members shall use outputs at their own risk.
Article 12Exclusion of antisocial forces
Members represent and warrant that they do not, and will not in the future, fall under the category of antisocial forces (such as organized crime groups and their members).
Article 13Cancelling membership
Members may cancel their membership at any time from the settings screen. On cancellation, the member's API keys are deactivated and their personal information is anonymized. Unused Tokens are handled as set out in [Handling of remaining balance on cancellation].
Article 14Changes to these Terms
We may change these Terms. If we make a material change, we will ask members to agree again the next time they log in.
Article 15Language
These Terms are written in Japanese. If a translation differs from the Japanese version, the Japanese version prevails.
Article 16Governing law and jurisdiction
These Terms are governed by the laws of Japan. The [Court name] shall have exclusive agreed jurisdiction as the court of first instance over any dispute relating to the Service.
